ACCEPTANCE OF TERMS OF USE AND OTHER POLICIES:  All references to ‘you’ or ‘your’ as applicable means the person that accesses uses and/or participates in the KhelaHobe platform on behalf of an entity, you represent and warrant that you have the authority to bind that entity. Your acceptance by the entity you represent and “you” and “your” herein shall refer to such entity.

1. Terms of Use. (The ‘terms of use’) govern your use of our website- khelahobe.club (the ‘website’) and our KhelaHobe application for mobile and handheld devices (the ‘App’) and any assignee and permitted licenses thereof. The website and the app are jointly referred and operated by ‘Hasan IT’. ‘We’, us and our herein shall refer to Khelahobe and our associates/partners/successors permitted assigns. Please read these terms of use thoroughly and carefully before you use the khelahobe platform as they contain provisions that define your limits, legal rights and obligations with respect to your participation in the khelahobe platform and your use of the services offered by the khelahobe platform( such services, collectively called the “services”). These terms of use and privacy policy (as defined below) constitute a legally binding agreement between khelahobe and you. By installing , downloading or even merely using the khelahobe platform, and by clicking on “I have read and agree to the terms of use “ you shall be contracting with khelahobe and you signify your acceptance to the Terms of use and other khelahobe policies( including but not limited to the privacy policy) as posted on the khelahobe platform from time to time, which takes effect on the date on which you download, install or use services, and create a legally binding arrangement to abide by the same. If you do not agree to the foregoing, you should not click to affirm your acceptance thereto, in which case you are prohibited from accessing or using the khelahobe platform. If you do not agree to any of the provisions set forth in the term of use, kindly discontinue accessing or participating in the services offered by the khelahobe platform immediately. By using the khelahobe platform you, agree that the terms, conditions and disclaimers set out in these Terms of Use are reasonable.
2. Privacy Policy. Khelahobe has established a privacy policy that explains to users how their information (‘User Content’) is collected and stored (‘Privacy Policy’). The privacy policy is referenced above and hereby incorporated in the Terms of use. Your use of KhelaHobe is governed by the privacy policy, which is located at- club/terms.
3. All the users of KhelaHobe will book the venue through app platform. Bookings will be updated as soon as the payment will be made for booking the ground.
4. Slot Availability: Venue partner must ensure the slot availability through the app calendar. Venue partner will be responsible for updating and ensuring accurate data of available booking slots. Slot booking is not refundable.
5. Cancellation/ Rescheduling: Bookings cannot be cancelled but only rescheduled to another booking slot. All rescheduling will be subject to availability of slots and must be notified before 24 hour
6. End User License Agreement (EULA): The following terms and conditions constitute an agreement between you and KhelaHobe regarding the use of the software or application provided by KhelaHobe. By installing, downloading, or using the KhelaHobe platform and by clicking on “I have read and agree to the Terms of Use,” you shall be contracting with KhelaHobe and signify your acceptance of this EULA.Grant of License: KhelaHobe grants you a non-exclusive, non-transferable license to use the KhelaHobe software or application solely for your personal or internal business purposes, subject to the terms and conditions of this EULA.Restrictions on Use: You shall not, directly or indirectly:
   a. Copy, modify, distribute, sell, lease, sublicense, or otherwise transfer or exploit the KhelaHobe software or application;
   b. Reverse engineer, decompile, disassemble, or attempt to derive the source code of the software or application, except to the extent expressly permitted by applicable law;
   c. Remove, alter, or obscure any copyright, trademark, or other proprietary notices or labels on or in the software or application;
   d. Use the software or application in any manner that violates any applicable laws or regulations or for any unlawful purpose.Ownership and Intellectual Property: The KhelaHobe software or application, including all related intellectual property rights, are and will remain the exclusive property of KhelaHobe. This EULA does not convey any ownership rights in the software or application.Support and Maintenance: KhelaHobe may, at its discretion, provide support and maintenance services for the software or application. Such services may be subject to additional terms and fees.Limitation of Liability: In no event shall KhelaHobe be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the use of the software or application.Termination: This EULA is effective until terminated. KhelaHobe may terminate this EULA immediately if you fail to comply with any of its terms and conditions. Upon termination, you must cease all use of the software or application and destroy all copies thereof.Governing Law and Dispute Resolution: This EULA shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising under or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction]
7. User Data Share: KhelaHobe app will share user data to the venue partner for each reservation.
8. Venue Partner Data Usage: KhelaHobe will be entitled for sharing venue partner’s information (logo, location, posts, photos, pricing, contact information, promotional offers, and events) in app, website and social media platforms of KhelaHobe.
9. Prohibition of Objectionable Content: You are strictly prohibited from uploading, posting, or sharing any content that is objectionable, offensive, or violates applicable laws and regulations. This includes, but is not limited to, content that is defamatory, discriminatory, obscene, sexually explicit, violent, harassing, or infringing upon the rights of others.
10. Content Filtering Mechanism: The app employs a sophisticated content filtering mechanism to detect and remove objectionable material. While we strive to provide a safe environment, you acknowledge and understand that no filtering system is foolproof. Therefore, you agree that the app developer shall not be held liable for any objectionable content that may slip through the filtering process.
11. User Reporting of Objectionable Content: If you encounter any content that you believe violates our terms and conditions, you must promptly report it to the app developer through the designated reporting feature. Your report should include sufficient details and evidence to support your claim. We will investigate all reports and take appropriate action as deemed necessary in our sole discretion.
12. Blocking Abusive Users: To protect your experience within the app, we have implemented a user-blocking feature. If you encounter another user who engages in abusive or harassing behavior, you have the right to block that user from further communication or interaction with you. However, please note that blocking a user does not relieve them of their responsibility for their actions.
13. Timely Response to Objectionable Content Reports :The app developer is committed to promptly addressing reports of objectionable content. Upon receiving a report, we will undertake a thorough investigation within a reasonable timeframe, not exceeding 24 hours. If we determine that the reported content violates our terms and conditions, we reserve the right to remove such content and take appropriate disciplinary action against the responsible user, including suspension or termination of their account.
14. Indemnity:   KhelaHobe platform will not be responsible for any cost, damage, liability or other consequence of any of the actions of the Users of the KhelaHobe platform. You agree to release and fully indemnify KhelaHobe and/or any of its directors, shareholders, officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Users of the KhelaHobe Platform and specifically waive any claims that you may have in this behalf under any applicable laws of the country.
